Clients often ask: How long will my case take to resolve? The answer is, it depends. It depends on several factors. For an injury case, and a lot of our clients are injury clients, it’s going to depend on the amount of treatment that you’re receiving. In some cases, some clients are done with treatment in 90 days; some are done in 30 days; with some, it takes two years. Some require surgical intervention. There’s really no actual formula for how long the case will take. It all depends on the case. In the state of Florida, there’s a four-year statute of limitations for bringing a personal injury action based on negligence. That doesn’t mean that you have to wait four years, that’s just the last possible date. Four years from the date of the accident is the last possible date where you can file a lawsuit.
There are so many different types of cases. Some of our clients will have surgery, and that sometimes will prolong the case itself because we do not want to demand compensation from an insurance carrier, for instance, until we know the exact value of your claim. A lot of times we’re not going to know what that exact value is until we get a full picture of your medical history. If you’re starting out with conservative care and you get physical therapy, and then you need injections and then you may need surgery, we need to find out where that endpoint is. When we’re at that endpoint, we have a full picture of your case, and at that point we can send a letter to the insurance company and say this is what the case is worth.
It’s very difficult at the outset of a case to know exactly what the full value of your case is. In a firm like ours, we don’t have a million files. We take each case individually, we look at it, and we find out and answer for ourselves what the maximum value is that that case is worth. Some cases aren’t worth a whole lot, some are. It depends on the severity of your injuries
