A question that we’re frequently asked at consults is, “How much is my case worth?” This is an extremely complicated question and depends on a number of factors. With personal injury cases, you’re entitled to several measures of damages. You are entitled to the cost of past medical bills, the cost of future medical bills, the cost of the amount of money that you’ve lost from work, the amount of money that you may lose continuing to work if you’re no longer able to do your job, and, in Florida, if you have a permanent injury, you’re entitled to past and future pain and suffering.
All of those past and future medical bills and your lost wages are easy to calculate. The significant issue with damage awards is past and future pain and suffering. There is absolutely no guidance for juries on how they should come up with a pain and suffering award— it just has to be fair and just, in light of the circumstances. This can depend on how the jury perceives you, how you do in a deposition, how you are currently experiencing pain, and there is absolutely no way to predict accurately what your case would be worth.
