What is a Trial Lawyer?

A question that we get a lot is what is the law firm’s philosophy on going to trial. One of the motto’s or slogan of our firm is, “We’re trial lawyers.” What does that mean? That could mean a lot of different things. We can’t speak for other law firms, but we can speak to what we do over here. Going to trial is not necessary, in most cases. It doesn’t mean that if we settle the case and we don’t go to trial that we’re not trial lawyers. What this means for our firm is that we will take the case to its absolute maximum level to get the maximum value on a case. A lot of times, insurance companies aren’t going to offer you maximum value. As a matter of fact, they’re not going to offer you maximum value until you take the case all the way to trial. A small percentage of cases actually get tried. The cases that usually get tried are the ones in which the insurance company is offering very little and the value of the case is much more than what the insurance company is offering. Here’s a classic example. We had a client where the maximum insurance coverage on that case was $100,000. We did a demand letter, asking for the $100,000. The insurance company offered us $15,000. We filed a lawsuit on behalf of our client. Later on in the case, we actually came off the $100,000 so that the case would not continue on and on to perpetuity. The problem is the insurance company stayed firm with their $15,000. That was a case that we had to try on behalf of our client, and, fortunately, we were able to get not only the $100,000 limits, but we were also able to get attorney’s fees because of the insurance company delaying the case. Every case is different, and you can call us for an evaluation. Just remember, we can’t evaluate the full value of your case until later on when you’re done with your medical treatment.
