I Don’t Want to Sue the Other Person We hear from clients all the time that they don’t feel comfortable suing the person that hit them because they were nice and really wanted to make sure they were okay. We want to let people know that we’re really not suing the person that hit you. Whenever we do sue somebody, it is their name on the lawsuit, but, realistically, we are going against the insurance companies. The insurance company has their own lawyers that they have that protect their insured. The insured does not have to pay the attorney’s fees. The insurance company is the one that pays it. Really, when we’re filing lawsuit, we’re filing against insurance companies, not people.

There’s a huge misconception that we are taking these people and suing them, and they’re going to end up having to pay out of their own pocket, and that is not the case. We like to tell our clients that they should not feel bad. Another part of that is that you should not feel bad for getting compensation for your injuries. You were injured through no fault of your own, and there’s no reason why you should have to suffer because someone else wasn’t paying attention or wasn’t taking the proper care that they were supposed to.
